Encontró la Corte que en este caso solo se configuró un conflicto aparente, en la medida en que la controversia entre las autoridades judiciales involucradas no se basó en criterio de competencia alguno.
Se resuelve el asunto ordenando enviar el expediente a la Sala de Decisión Penal del Tribunal Superior de Bogotá para que, de forma inmediata, inicie el trámite de amparo respectivo y profiera la decisión de fondo a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el Auto del 23 de febrero de 2021 proferido por el Tribunal Superior de Distrito Judicial de Bogota -Sala de Decision Penal-, dentro del expediente ICC-3965.
- SEGUNDO. REMITIR al Tribunal Superior de Distrito Judicial de Bogota -Sala de Decision Penal- el expediente ICC-3965, para que, de forma inmediata, inicie el tramite de amparo respectivo y profiera la decision de fondo a que haya lugar en relacion con la accion de tutela interpuesta por Roy Leonardo Barreras Montealegre contra el Consejo Nacional Electoral.
- TERCERO. ORDENAR que, por Secretaria General, se comunique la decision adoptada en esta providencia a la parte accionante y al Tribunal Administrativo de Cundinamarca, Seccion Segunda, Subseccion "E".
